Draft with LAIWhich route to choose
- Civil registry (ДРАЦС) — if both spouses agree and there are no minor children (art. 106 of the Family Code). A joint application is filed; the marriage is dissolved after one month.
- Joint application to court (art. 109) — when there is agreement but there are children. It is filed together with an agreement on where the children will live and how the other parent will participate in their upbringing and support. The court rules one month after filing.
- Lawsuit by one spouse (art. 110) — when there is no agreement. The court examines the actual relationship and may allow time for reconciliation.
Where and how to file
Court route. The claim goes to the court where the defendant lives; if minor children live with you or travel is difficult for health reasons, you may file where you live (art. 28 of the Civil Procedure Code). You can file on paper or online through "E-Court" (cabinet.court.gov.ua, log in with a QES or Diia.Signature).
Via the civil registry (ДРАЦС). A joint application by mutual consent is currently submitted in person at the registry office. Fully remote divorce in the Diia app is, as of July 2026, only in beta testing and only for couples with no minor children (online application, a videoconference with a registrar, the certificate by post) — there is no general rollout yet. Diia already offers related online services: an extract and a re-issued divorce certificate.
Restrictions
A divorce claim cannot be filed during the wife's pregnancy or within one year after the birth of a child, except in the cases listed in art. 110(2) of the Family Code (e.g. unlawful conduct towards the spouse or the child).
What to state in the claim
- the spouses' details, the date and place of marriage registration (marriage certificate);
- details of the children and your proposal on their residence and support;
- the reasons for the divorce and why living together became impossible;
- the request to dissolve the marriage; optionally alimony or property-division claims (these can also be filed separately).
Legal basis
- Family Code of Ukraine, arts. 105–115;
- Civil Procedure Code of Ukraine, art. 28.
