If a parent does not contribute to a child's upkeep, child support can be claimed through court. A voluntary notarised agreement is possible (art. 189 of the Family Code), but absent agreement the judicial route applies.
Where and how to file
You may file where you live (art. 28 of the Code) — no need to travel to the defendant's court. Alimony claimants are exempt from the court fee.
You can file on paper (via the court office or by post) or online through "E-Court" (cabinet.court.gov.ua), logging in with a QES or Diia.Signature. The same system is used to file an application for a court order.
Two routes
- Court order (arts. 160–161 of the Civil Procedure Code) — a simplified procedure without hearings. Suitable when you claim a share of income or a fixed sum and paternity is not disputed. Issued within days.
- Lawsuit — when there is a dispute (about the amount or parenting) or you also claim extra expenses for the child (art. 185 of the Family Code).
The amount
- a share of income: typically 1/4 for one child, 1/3 for two, 1/2 for three or more (art. 183 of the Family Code);
- or a fixed monthly sum (art. 184) — when the payer's income is irregular or hidden;
- the guaranteed minimum is 50 % of the subsistence minimum for a child of the relevant age.
The court weighs the health and financial situation of the child and the payer, and other dependants.
What to state
The parties' details, the child's details (birth certificate), the circumstances (marriage/divorce, who the child lives with, the defendant's contributions), the amount and form of support sought, and any evidence of the defendant's income.
Legal basis
- Family Code of Ukraine, arts. 180–192;
- Civil Procedure Code of Ukraine, arts. 28, 160–161, 175.
